In consideration of the agreement of WRM Strata Management & Real Estate Services Ltd. (“WRM”) to perform, cause to be performed and/or oversee the below Work within a strata as detailed below at the request of the owner of the Strata Lot, the Owner agrees as follows:
1. The Owner does for itself, its heirs, executors, administrators, successors and assigns hereby release, remise and forever discharge WRM and its successors and assigns of and from all manner of action and actions, cause and causes of actions, suits, debts, dues, sums of money, claims, demands, claims for contribution, claims for indemnification and proceedings, contracts, agreements, covenants, bonds and obligations of every nature or kind whatsoever, at law or in equity, which the Owner has had or now has or which it may or shall have by reason of any matter, cause, or thing whatsoever existing in connection with, arising out of, or in anyway relating to the Work.
2. The Owner will at all times indemnify WRM and hold it harmless from and against any and all losses, claims, expenses, damages or liabilities, of whatever kind or nature, including the full amount of WRM’s legal costs incident to the recovery thereof, which WRM may sustain or to which it may become subject arising out of or relating in any way to the Work or this Agreement.
3. The release and indemnity set out in this instrument applies in relation to all acts or omissions by WRM and its contractors, agents and employees.
